Okay, I don't want to be a fun ruiner here, but just wanted to say up front that no one should ever drink and drive.
But IF you want to have a beer while riding your trusty mule, horse, or giant tortoise in Texas, it's perfectly legal. That might be surprising, but you can't ride and drive at the same time.
Texas state law states that driving while intoxicated (DWI) or the old way of saying it, driving under the influence (DUI) applies specifically to motor vehicles. According to the Texas Penal Code, a vehicle is a device used for transportation on land and does not include animals.

It's true what this man is saying in this now-viral TikTok. It looks like his horse might have already heard this story.
Even though you can't get a DWI, that doesn't mean you should ride a horse irresponsibly. If you do cause an accident or harm someone while riding under the influence, there is a good chance that you will receive a charge.
You could still get a ticket for public intoxication, animal abuse, reckless endangerment, or all three. Horses can be unpredictable, and if you aren't in control it could lead to accidents.

It's legal to have a cold one on horseback in Texas for now, just make sure to stay safe. There are worse things than a DWI, like a broken back.
